Summary judgment to a former employer and a union on claims of wrongful discharge and breach of the duty of fair representation is affirmed where no genuine issues of material fact existed as to a breach of the duty of fair representation, and thus, the employer was entitled to judgment as a matter of law on a claim for wrongful discharge and breach of a collective bargaining agreement.
