Summary judgment for defendants, a hospital and administrators, on claims brought by a former surgeon under the Americans with Disabilities Act (ADA) and the Rehabilitation Act is vacated in part as to an ADA Title III claim where plaintiff's death rendered the claim moot, and affirmed as to an ADA Title I claim and a Rehabilitation Act claim since plaintiff was not an employee of the hospital.
