United States Eighth Circuit

Janssen v. Minneapolis Auto Dealers Benefit Fund, 05-1396

Summary judgment for plaintiffs in an action alleging an unlawful denial of benefits under the Employee Retirement Income Security Act (ERISA) is affirmed where the district court did not err in applying a sliding scale abuse of discretion standard, and a plan's decision to deny benefits was unreasonable.
