US v. Wintermute, 04-4083, 05-2433

Convictions for conspiracy to defraud the United States and making a false statement to the Office of the Comptroller of the Currency are affirmed over claims of error regarding: 1) exclusion of expert testimony; 2) lack of an evidentiary hearing on allegations of tainted jury deliberations; and 3) sufficiency of the evidence. A sentence is vacated and remanded for resentencing.
