United States Eighth Circuit

Winskowski v. City of Stephen, 05-2777

A government employee who fails to request post-termination process cannot later sue for having been deprived of it. Denial of judgment as a matter of law for defendant-municipality on a claim brought by a former police officer alleging that defendant deprived plaintiff of a liberty interest in his good name is reversed where plaintiff never sought a name-clearing hearing before suing for damages.
