United States Eighth Circuit

US v. Elam, 04-4170

Defendant's conviction for being a felon in possession of a firearm is affirmed over his claim of erroneous denial of a motion to suppress where an officer reasonably believed that a third party, the lessee of a home, had sufficient "common authority" to consent to a search when she handed the officer a key to a locked cabinet.
