United States Eighth Circuit

Henderson v. Munn, 05-1403

Denial of defendant-police officer's summary judgment motion claiming qualified immunity in a civil rights case alleging excessive force during an arrest of plaintiff is affirmed where there was sufficient evidence to allow a jury to find the force used in the arrest unreasonable, and that a reasonable officer would have known his actions violated plaintiff's right to be free from excessive force.
