Ochoa-Carrillo v. Gonzales, 04-2038

Petition for review of an order reinstating a prior order of removal is affirmed where: 1) an agency's identity determination was supported by substantial evidence, and 2) a challenged regulation was a valid interpretation of the Immigration and Naturalization Act and its summary reinstatement procedures did not violate petitioner's due process rights.
