Delcastillo v. Odyssey Res. Mgmt., Inc., 04-3676

Award of statutory penalties, compensatory damages, and attorneys' fees and costs in an Employee Retirement Income Security Act (ERISA) case is reversed where plaintiffs may be entitled to recover unreimbursed medical expenses under ERISA but are not entitled to recover statutory penalties under the Consolidated Omnibus Budget Reconciliation Act (COBRA).
