Aviation Charter v. Aviation Research, 04-3040

In an action alleging that the publisher of air charter safety ratings defamed plaintiff-air charter company by stating its operations did not meet adequate safety standards, the publisher's statement that the company had a history of problems was not a false statement since the company had experienced two fatal crashes.
