UNITED HOSPITAL v. THOMPSON, 03-3012

Plaintiff's request for payments under the Medicare reimbursement program for expenses related to the treatment of poor and disabled patients is denied where defendant's interpretation of "Program Memorandum A-99-62" to exclude plaintiff's claims was not arbitrary, capricious, irrational or discriminatory.
