Summary judgment in favor of defendant, regarding a challenge to the decision to approve harvesting timber in Mark Twain National Forest, is affirmed where defendant's decision that the project did not have a significant impact on the Indiana bat was not arbitrary or capricious and thus not a violation of National Environmental Policy Act.
