CUDWORTH v. MIDCONTINENT, 03-2187

In a personal injury case, district court's grant of summary judgment to defendant-landowner on the basis of a North Dakota recreational use immunity statute is affirmed where immunity applied even though defendant placed the injury-causing rope barrier on the land and irrespective of plaintiff's status as invitee, licensee or trespasser.
