United States Eighth Circuit

ARMSTRONG v. KEMNA, 02-2215

Trial court did not abuse its discretion in denying request for a continuance to await the possible arrival of out-of-state witnesses with unknown testimony. Remanded to consider whether trial counsel rendered ineffective assistance by failing to secure the attendance of these witnesses or a continuance in light of the Uniform Act.
