ASSICURAZIONI GENERALI S.P.A. v. BLACK & VEATCH CORP., 03-1431
Summary judgment awarding coverage to defendants-contractors under marine cargo insurance policy is affirmed. The language of the contract is unambiguous that a survey is required only for items listed in the policy; endorsements, unsupported by consideration, did not retroactively impose an obligation to obtain surveys on other items; reimbursement for consequential loss is upheld.
