HAGI-SALAD v. ASHCROFT, 02-3437

In denying Somalian alien's asylum application, the BIA neglected to apply 8 C.F.R. section 208.13(b)(3), a new regulation defining when the ability to relocate within an applicant's country of origin causes him to be ineligible for asylum. Remanded for further proceedings.
