MENENDEZ-DONIS v. ASHCROFT, 02-3692

Substantial evidence supported the IJ's conclusion that Guatemalan alien had not been subjected to political persecution and did not have a well-founded fear of future persecution; while her rape by unknown assailants was a brutal crime, evidence supported the finding that it was not an act of political persecution, thus she was not entitled to humanitarian asylum.
