United States Eighth Circuit

US v. TURNING BEAR, 03-2280

In a case involving sexual abuse of minors, the district court violated defendant's right to put on witnesses in his defense when it excluded opinion testimony from the foster parent with whom the alleged victims lived. Use of closed-circuit television to present one victim's testimony violated defendant's right of confrontation; admission of a 12-minute video of victim's out-of-court statements was error; remanded.
