SMITH v. CHASE GROUP, INC., 02-4106, 03-1007

Evidence was sufficient to show parties entered into a binding oral contract concerning commissions on multiple retainer agreements. District court properly instructed the jury to aggregate damages for separate violations of the contract, but erred in reversing the jury finding that defendant's refusal to pay commissions was a willful act under Kansas law.
