CURBY v. SOLUTIA, INC., 03-1545

Plaintiff had no reasonable basis to believe she was entitled to severance benefits when she offered her resignation, and defendant's acceptance of the offer did not amount to retaliation for assertion of ERISA rights. Because she resigned, she cannot show that she suffered an adverse employment action and cannot raise discrimination claims under Title VII.
