District court's dismissal of two counterclaims for breach of fiduciary duty and conversion as moot is reversed. Successful summary judgment award against trustee does not bar claims against that trustee in its individual capacity where these claims satisfy both exceptions to the "opposing party" restrictions of FRCP rule 13.
