United States Eighth Circuit

OLSON v. BLOOMBERG, 02-1874

District court did not err in denying prison guard's motion for summary judgment based on qualified immunity in a 42 U.S.C. section 1983 claim, as issues existed whether the guard knew there was a substantial risk plaintiff's decedent would commit suicide, and whether he deliberately disregarded the risk by encouraging plaintiff's decedent to do so.
