United States Eighth Circuit

BURKETT v. GLICKMAN, 02-1827

Twenty of plaintiff's twenty-one failure-to-promote claims were not the subject of timely EEO complaints and could not be considered. In complaint properly before the court, plaintiff failed to show that defendant's legitimate, non-discriminatory ground for its decision was a pretext for race discrimination.
