United States Eighth Circuit

US v. HERNANDEZ-HERNANDEZ, 02-3246

District court's findings that defendant made incriminating statements before he was arrested and handcuffed are not clearly erroneous. Once defendant told the officers he was an illegal alien, they had probable cause to arrest him without a warrant.
