United States Eighth Circuit
REIMER v. CITY OF CROOKSTON, 02-1554
Sufficient evidence created a jury issue under Restatement, Torts (2d) section 343A, as to whether a school district and city should have anticipated the harm presented by a corroded boiler despite the obviousness of the condition. Genuine issues of fact exist as to whether plaintiff assumed the risk under Minnesota law.
