Real Estate Settlement Procedures Act section 8 is an anti-kickback provision that unambiguously requires at least two parties to share a settlement fee in order to violate the Act, and in order to state a claim for violation of the Act, plaintiffs must plead facts showing defendant illegally shared fees with a third party.
