United States Eighth Circuit

District court must apply the U.S.S.G. in place when a crime was committed if application of the U.S.S.G. in effect at sentencing would result in a more severe sentence. Where sentence imposed would be same under either guideline, application of the guideline in place at sentencing was not an Ex Post Facto Clause violation.
