District court did not abuse its discretion in granting government's motion to dismiss certain counts of indictment for conspiracy to produce methamphetamine, as the motion was motivated by a desire to clarify presentation of the case to the jury, and such motive did not evidence bad faith; constitutional challenges to 21 U.S.C. sections 841 and 846 rejected.
