United States Eighth Circuit

In appeals from a capital murder conviction, 1) defense counsel's failure to call four defense witnesses to testify, and appellate counsel's failure to raise a witness's recantation, did not amount to ineffective assistance; 2) prosecution's non-disclosure of a witness's plea agreement did not violate Brady v. Maryland, 373 U.S. 83, and 3) reference to failure to produce alibi witnesses did not violate right to remain silent.
