United States Eighth Circuit
US v. SMALLEY, 01-3898
Juvenile adjudications can be characterized as "prior convictions" for Apprendi purposes, thus enhancement of a sentence under the Armed Career Criminal Act, based in part on prior juvenile adjudications, was proper; due process rights were not violated where defendant was afforded an opportunity to withdraw his plea.
