OMNI BEHAVIORAL HEALTH v. MILLER, 01-1948

Officer's conduct in investigating child abuse at plaintiff's foster care facility was not arbitrary and he was entitled to qualified immunity on due process claims; with respect to Fair Housing Act claim, defendant established a legitimate, non-discriminatory basis for his investigation, which plaintiff failed to show was pretextual, and defendant was entitled to summary judgment.
