Nebraska's "exceptional depravity" statute, Nebraska Revised Statutes Sections 29-2523(1)(d), which allows enhnaced sentencing in a murder case if the defendant purposefully selects a victim on the basis of age, remains unconstitutionally vague even after its amendment, and the statute may not be used as a basis for defendant's death sentence.
