US v. SWICK, 00-3973

A plea agreement that stated defendant's incrimmiating statements would be used against him if he breached the plea agreement will allow those statements into evidence at trial after defendant successfully withdrew from the plea agreement so long as defendant voluntarily entered into the agreement.
