United States Eighth Circuit

INITIATIVE & REFERENDUM INST. v. JAEGER, 99-3434

North Dakota residency requirement for petition circulators is constitutional, as state has compelling interest in preventing fraud and regulation does not unduly restrict speech, and prohibition on paying petition circulators on a per signature basis is also constitutional in light of state's interest in preventing signature fraud.
