Existence of a contract between plaintiff and defendants' company does not bar plaintiff from suing defendants in tort where no damages or other remedies for breach of contract are sought. Plaintiff may seek recovery for fraud, conversion or negligent misrepresentations based on defendants' statements concerning return of anti-dumping customs duties.
