Distict court’s summary judgment that deceased BSNF employee was not acting within the scope of his employment when driving to work affirmed. Deceased was a BNSF railroad employee, but in court’s judgment no jury could reasonably find BSNF negligent in any way, so the question of work status need not be addressed.
