United States Seventh Circuit

Gant v. Hartman, 18-1287

Held that a man who pleaded guilty to armed robbery may proceed with an excessive-force lawsuit against a police officer who shot him without allegedly giving him a chance to surrender. The question of whether the officer had qualified immunity could not be resolved on summary judgment because it depended on disputed issues of fact. Dismissed the officer's appeal from a denial of summary judgment.
