Ruark v. Union Pacific Railroad Co., 17-2429
Held that an injured railroad employee could not proceed with his claim under the Federal Employers Liability Act, because he failed to satisfy the prerequisites for the theory of negligence under which he pursued the case — res ipsa loquitur. Affirmed judgment as a matter of law in favor of the railroad.
