Kleber v. CareFusion Corp., 17-1206
In an en banc ruling, held that the Age Discrimination in Employment Act does not protect outside job applicants from disparate-impact age discrimination. A 58-year-old jobseeker brought suit challenging the legality of a job advertisement that required seven years or less of relevant experience. Affirming a dismissal, the Seventh Circuit held that the ADA does not authorize outside job applicants to bring disparate-impact discrimination claims.
