Lovett v. Herbert, 17-1668
Held that correctional officers had qualified immunity from a claim that they violated the Fourth Amendment rights of a man arrested for drunk driving who fell out of an upper bunk bed at the jail, suffering injuries that eventually led to his death several months later. Reversed the denial of qualified immunity, in this lawsuit alleging that an intoxicated person should not have been assigned to an upper bunk.
