Smith v. GC Services Limited Partnership, 18‐1361
Held that a collection agency waived any right to arbitrate a consumer's Fair Debt Collections Practices Act lawsuit as a result of waiting too long to seek arbitration. Affirmed the denial of a motion to compel arbitration, without reaching the question of whether the collection agency could enforce the arbitration agreement between the consumer and another party as a non-signatory.
