United States Seventh Circuit
Minerva Dairy, Inc. v. Harsdorf, 18‐1520
Held that Wisconsin's requirement that butter sold at retail be graded for quality and bear a label stating its grade was rationally related to the state's legitimate interest in consumer protection and did not discriminate against out‐of‐state businesses, in a lawsuit brought by an Ohio‐based family‐owned dairy company alleging that the requirement violated the Due Process Clause, the Equal Protection Clause, and the dormant Commerce Clause. Affirmed summary judgment for the state defendants.
