Sutherland v. Wal-Mart Stores, Inc., 10-2214

In plaintiff's against her employer, Wal-Mart Stores, Inc., claiming, among other things, hostile work environment based on sex discrimination, retaliation for reporting sex discrimination, and negligent infliction of emotional distress, district court's grant of summary judgment in favor of Wal-Mart is affirmed as, plaintiff did not present evidence that would allow a jury to conclude Wal-Mart is liable for the assault committed against her by a co-worker.
