Naik v. Ingelheim, 09-2960
In plaintiff's suit against his former employer claiming violations of the Age Discrimination in Employment Act and Title VII of the Civil Rights Act, district court's grant of defendant's motion for summary judgment and denial of plaintiff's motion for reconsideration are affirmed where: 1) plaintiff failed to meet his employer's expectations because he falsified his call records; 2) plaintiff failed to establish that similarly situated employees not in his protected class were treated more favorably; 3) even if plaintiff had met his initial burden, the district court correctly held that his claims still fail because he cannot show that the employer's nondiscriminatory reason for his termination was pretextual; and 4) district court did not abuse its discretion in denying plaintiff's Rule 59(e) motion seeking reconsideration.
