Montgomery v. Am. Airlines, Inc., 08-3951
In plaintiff's suit against his employer, American Airlines, claiming two civil rights violations relating to his race, district court's grant of the employer's motion for summary judgment is affirmed where: 1) plaintiff failed to present any evidence that would allow a reasonable jury to impute liability to the employer even if plaintiff had proven that his working environment was hostile; and 2) plaintiff failed to establish a prima facie case of of racial discrimination, and even if he had, he did not establish a triable issue of fact as to whether the employer's reasons for demoting him were merely pretextual.
