United States Seventh Circuit
Superl Sequoia Ltd. v. Carlson Co., Inc., 09-2406
In a furniture manufacturer's suit for breach of contract against another furniture manufacturer, arising from the latter's bid proposal to Macy's Inc. for equipment and services needed to turn portions of 226 stores into settings for a promotion, district court's judgment is vacated and remanded with instructions to calculate the net judgment as an email exchange between the parties shows that they were to be treated alike, and using plaintiff's $3.4 million bid as a cap but not as a floor would violate that symmetry.
