US v. Williams, 09-3174
Defendant's conviction for illegal possession of a firearm and various drug distribution offenses are affirmed where: 1) because defendant cannot satisfy his burden under either prong of the Strickland standard, the district court's abuse of discretion in dismissing defendant's concerns regarding his attorney's performance, was harmless; 2) because defendant was convicted of a violent felony, his claim that section 922(g)(1) unconstitutionally infringes on his right to possess a firearm is without merit; and 3) defendant's argument that the district court erred in applying the 18 U.S.C section 3553(a) factors because the court failed to consider his non-frivolous sentencing arguments is rejected.
