United States Seventh Circuit

US v. Arberry, 09-2668

In a prosecution of defendant for conspiracy to distribute fifty grams or more of crack cocaine, five kilograms or more of cocaine, and marijuana, district court's imposition of a 151-month sentence is vacated and remanded as the district court was required to address defendant's one-to-one ratio argument and the record does not show that defendant's crack/powder argument was addressed.
