Murphy v. Eddie Murphy Prod., Inc., 09-3267

In plaintiff's suit against the famous television and a motion film entertainer, Eddie Murphy, and others, claiming that defendants used copyrighted material from his videotape to create and broadcast an animated television show "The PJs," district court's denial of plaintiff's motion for an extension of time to file an amended complaint in dismissing his third lawsuit is affirmed as the district court was well within its discretion to deny plaintiff's motion because he did not miss the court-ordered deadline due to excusable neglect. Furthermore, the futility of plaintiff's proposed amendment serves as an additional, independent ground for refusing to enlarge the time for him to file his amended pleading.
