Levan v. George, 09-3223
In plaintiff's suit against two county sheriff deputies for false arrest and excessive use of force, arising from arrest of plaintiff for disorderly conduct, defendants' appeal of the district court's denial of their motion for summary judgment based on qualified immunity is dismissed for lack of appellate jurisdiction as it is readily apparent that the question of qualified immunity turns on genuine issues of material fact.
